2013国际货运代理人英语完整讲义：Unit1

　　英文原文：On the first of July, 2007, the UCP600 (Uniform Customs and Practice for Documentary Credits) came into force. This document is the latest version (sixth revision) of the UCP, a set of rules first drafted in 1933 by the ICC in Paris as the applicable legal framework under which a Letter of Credit (L/C) operates internationally. UCP600 replaces the former UCP500 version.

　　《跟单信用证统一惯例》修订的原因

　　英文原文：The primary objective of the ICC, which was established in 1919, is facilitating the flow of international trade. It was in that spirit that the UCP were first introduced.

　　《跟单信用证统一惯例600》的结构

　　1、UCP600 不同于UCP500分为7个部分，每个部分以开头字母A到G排序，其大致结构如下：

　　1) Provisions and Definitions (Articles 1~3); 定义解释(第1~3条)

　　2) Form and Notification of Credits (Articles 9~11); 信用证修改通知及其格式 (第9~11条)

　　3) Liabilities and Responsibilities (Articles 4~8; 14~16); 信用证有关方的责任和义务(第4~8条;第14~16条)

　　4) Nominated Banks (Articles 12~13); 指定，银行之间的偿付安排(第12~13条)

　　5) Documents (Articles 17~28); 信用证相关单据(第17~28条)

　　6) Miscellaneous Provisions (Articles 29~37); 各种相关规定

　　7) Transferable Credit (Articles 38); 可转让信用证

　　8) Assignment of Proceeds (Articles 39); 款项让渡

　　2、交易者应注意熟悉的条款：

　　1)1~3; 4~8, and 14~16: these articles set out the basic responsibilities of the banks when examining documents tendered for payment under Letters of Credit governed by the UCP600. 第1~3,4~8和14~16条：这些条款阐明了《跟单信用证统一惯例600》中银行审核信用证付款单证时的基本义务。

　　英文原文：There are a number of articles in the UCP600, as there were under the UCP500, that regulates exclusively the relationship between the banks themselves, i.e., the rights and responsibilities as between issuing, confirming, and nominated banks. Very useful clarification is given in these articles concerning the rights and obligations of Advising, Confirming, Issuing, and Nominated Banks.

　　英文原文：This article describes the standard for examination of documents by the banks. For the examination of documents, the banks now have a maximum of five banking days following the day of presentation, and no longer the “reasonable time not exceeding 7 banking days”.

　　英文原文：The deletion of the criterion of “reasonable time…” might mean that that traders have to accept that banks, despite an earlier decision on conformity, could now wait for the fifth day to pay the L/C amount to the seller.

　　英文原文：Furthermore, and in order to reduce instances of discrepancies, Article 14 (d) of the UCP600 relating to the issue of standard of examination now clarifies that data in a document, when read in context with the credit, the document itself and international standard banking practice, need not be identical to, but must not conflict with data in that document, any other stipulated document, or the L/C. This replaces the old text of “inconsistencies on the face of the documents” applied by the UCP500.

　　英文原文：Bills of lading may now allow transshipment, provided that the entire carriage is covered by one and the same bill of lading.

　　英文原文：To avoid mistaken references to the UCP500 or to facilitate a smooth transition to yet another version of the UCP600 in the future, sales and purchase agreements might in their L/C – or payment clause, refer to the “L/C subject to the UCP in its latest version”.
